Terms and Conditions for the use of the PES Rankings Point Store


General

1. The owner of this web site is Konami Digital Entertainment GmbH whose address is 389 Chiswick High Road, London, W4 4AL (‘KOE’/’PESRanings’/‘we’ /‘us’/‘our’).
2. Your contract for redemptions made through the points store is with Konami of Europe, and you undertake that any and all goods ordered by you are for your own private and domestic use only.
3. If you are under eighteen years old, when you place your order we will require approval from parent/guardian before your order can be dispatched. If an item has a legal age restriction i.e. 15 certificate DVD and you are younger than that age we will not dispatch the item to you. If you place an order and either your parent/guardian decline the order or you are not old enough to redeem the item you will lose any points spent on that item.
4. You agree that e-mail can be used as a long-distance means of communication.
5. You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it.
6. If there are any changes to the details supplied by you it is your responsibility to inform us as soon as possible.
7. You may cancel your order up to the point at which you get the dispatched order email. All cancellations must be made by email. All points spent on the order will be refunded to you.
8. All items claimed from the points store are covered by a manufacturer's warranty only, please remember to register for any warranties when you receive your items. We take no responsibility for items supplied that latter develop a fault. Should an item arrive faulty we will of course replace it.
9. We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.
10. You may not permit, create unauthorized framing of, or deep linking to, the Site or the creation of derivative works thereof from any other website under your management or control.
11. We may amend these Terms from time to time, and place the new version on the Site. When we do so, it will mention the fact on our home page (www.pesrankings.com).

Errors/Problems

1. While we try and ensure that all points required for an item on our points store are accurate, errors may occur. If we discover an error in the points required of items you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct points value or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel we will refund you any points used.
2. While we try to ensure we only list items that are in stock errors may occur. If you place an order for an item and we discover we do not have sufficient stock to cover this order will contact you by email and advise you of a restock date. You may then keep you order open or cancel your order. If you cancel we will refund you any points used.
3. If you have been incorrectly allocated points it is your responsibility to advise us as soon as you notice the misallocation. If you attempt to spend these points you may end up being suspended from www.pesrankings.com. Any of your points spent on these orders will not be refunded.
4. We do not accept liability for any errors and omissions and reserve the right to change information, point’s costs, specifications and descriptions of listed goods, products and services.
5. We will do our best to correct errors and omissions as quickly as practicable after being notified of them.

Dispatch

1. Your order can only be dispatched to the address specified in your www.pesrankings.com account details. Please ensure your address is correct before placing your order. If your order is dispatched to an inaccurate address we will not be able to replace it and unless it is returned to us you will miss out on the item. Any points spent on the order will not be refunded to you.
2. We will endeavour to dispatch all orders within 7 days of the order being placed but reserve the right to take up to 28 days to dispatch your order. Depending on the method of shipment, order may take between 24hr and 7days to arrive after your shipment email has been sent.
3. Once an item has been dispatched to you, we will email you to confirm the delivery method and expected arrival date. Once you receive this email your order is confirmed and any errors will be honoured.
4. In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, we shall, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount of points used for the goods in question PROVIDED THAT you notify us of the problem in writing (address details can be found at the bottom of the T&C’s) within 10 working days of delivery of the goods.
5. All orders will be shipped in full, should we have a problem with an item you have order your order will remain unfulfilled until that issue has been resolved.
